Petitioner herein seeks quashing of FIR No. 0037/2026 dated 07.02.2026, registered at Police Station K.M. Pur, for commission of offences under Sections 75(2)/78(2) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 354A/ 354D (2) IPC), along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.

The abovesaid FIR was registered on 07.02.2026 on the basis of complaint made by respondent No.2, a house wife in her 30’s and having four children.

She alleged that accused i.e. petitioner herein was stalking and asking her repeatedly to share her mobile number and even tried to hug her.

Respondent No.2 is present in Court and she has been duly identified by her counsel as well as by I.O.

Her husband is also present in Court.

Compromise deed dated 21.04.2026 is on record. When asked, respondent No.2 submitted that she has entered into abovesaid settlement as per her free will and without any pressure or undue influence from any corner and she would have no objection if the present FIR is quashed. She submits that the petitioner has apologized to her and she had, therefore, decided to forgive him. During course of the proceeding, the petitioner has, again, tendered his apology which, too, was accepted by respondent No.2.

Investigation is, though, over, charge-sheet has yet not been presented before the concerned Magistrate Court.

Petitioner is having no previous involvement in any other case.

In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any real public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioners.

Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR.

Consequently, to secure the ends of justice, FIR No. 0037/2026 dated 07.02.2026, registered at Police Station K.M. Pur, for commission of offences under Sections 75(2)/78(2) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 354A/ 354D (2) IPC), along with all consequential proceedings arising therefrom, is, hereby, quashed. Original affidavits of the parties shall be submitted to concerned SHO/IO within four weeks from today.

The present petition stands disposed of in aforesaid terms.
