Judgment
SANJEEV SACHDEVA, J. (ORAL)
The petitioner seeks regular bail in FIR No.150/2018 under Sections 448/380/323/509/506/34 IPC read with Section 3(1)(g)(r)(s)(w)(z)/3(2)(va) of SC & ST (POA) Act,
Police Station Moti Nagar. The petitioner has been in custody since 05.06.2018.
The allegations in the FIR are that the petitioner had permitted the accused, who were friends of her son and helped her in running of a shop, to occupy her
residential premises. Subsequently, it is alleged that when she asked them to vacate, they misbehaved with her and one of the co-accused used abusive language.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated and there are no allegations against the petitioner made out under the
provisions of the SC & ST (POA) Act. He submits that in the FIR there is no contention that the petitioner ever abused the complainant or used the language, which
is punishable under the Act.
Without commenting on the merits of the case and on perusal of the record, I am satisfied that the petitioner has made out a case for grant of regular bail.
Accordingly, subject to petitioner furnishing a bail bond in the sum of Rs.25,000/- alongwith one surety of the like amount to the satisfaction of the Trial Court, the
petitioner shall be released on bail, if not required in any other case. The petitioner shall not do anything, which may prejudice either the trial or the prosecution
witnesses. The petitioner shall not contact the prosecutrix or her family in the meantime.
The petition is disposed of in the above terms.
