This first application under Section 439 of Cr.P.C. has been filed for grant of bail.
The applicant has been arrested on 10.2.2022 in connection with Crime No.13/2022 registered at Police Station Rithorakalan, District Morena for offence under Section 34(2) of Excise Act.
According to the prosecution case, 103.68 bulk litres of country made liquor has been seized from the joint possession of the applicant and Amir Khan. The applicant is resident of Meena Basti Gothra Mandakhera, District Karoli (Rajasthan).
Although it is submitted by the counsel for the applicant that the applicant had come to Morena along with JCB machine but according to the prosecution case, the applicant was coming in a Bolero Jeep No.RJ34-UA-3462 in which 103.68 bulk litres of country made liquor worth Rs.48,000/- was seized.
The applicant has not disclosed that who is the owner of the Bolero Jeep in which illicit liquor was being transported.
Further, according to the State Counsel, the applicant has a criminal history and four more criminal cases have been registered in Meena Basti Gothra Mandakhera, District Karoli (Rajasthan).
At this stage, the counsel for the applicant seeks permission of this Court to withdraw this application.
It is, accordingly, dismissed as withdrawn.
