Judgment
Heard on IA No.3227/2020, an application for urgent hearing.
On due consideration, application (IA No.3227/2020) is allowed.
Also heard on IA No.3068/2020, an application for suspension of sentence on behalf of the appellants Vikram Singh Gurjar S/o Mangu Singh Gurjar and Pappu Singh Gurjar S/o Mangu Singh Gurjar. Appellants have filed this appeal against the judgment dated 16.03.2020 passed by the Special Judge, Protection of Children from Sexual Offences Act, 2012, Ratlam in Session Trial No.53/2017; whereby the learned trial Court has convicted them under Section 354/34 of the IPC and sentenced them to undergo RI for one year with fine of Rs.2,000/-, with further default stipulation.
Learned counsel for the appellants submits that the applicants have a good prima facie case and they hope succeed. The Trial Court has suspended the jail sentence upto 15.04.2020 and thereafter in compliance of the order passed by the Apex Court they have not surrendered before the Court. Hence, prays for grant of suspension of sentence to the appellants.
I have heard learned counsel for the parties.
Considering the facts and circumstances of the case, the application is allowed and it is directed that the jail sentence passed against the appellants shall remain suspended and they be released on bail upon their depositing the fine amount (if already not deposited) and furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) each with one solvent surety each in the like amount to the satisfaction of the trial Court for their appearance before the Registry of this Court on 20.09.2021 and on such further dates as may be fixed in this behalf by the Registry during the pendency of this appeal.
Record of the Trial Court be requisitioned and list for final hearing in due course.
