By means of this writ petition, petitioner has challenged the result of recruitment on the post of Revenue Sub-Inspector (Patwari) dated 06.07.2023, annexure-11 to the writ petition, pursuant to the selection held vide advertisement dated 14.10.2022.

Heard learned counsel for the parties.

The case of the petitioner is that pursuant to the aforesaid advertisement, he had applied for the post of Revenue Sub-Inspector (Patwari) and had appeared in the written examination and has obtained 76.3126 marks out of 100 in the said examination.

Learned counsel for the petitioner submitted that respondent no.3 has been selected who scored 76.578 marks in the said examination.

The grievance of the petitioner disclosed in the writ petition is that the petitioner has attempted a Question No.77, which is quoted below:-

“Which portal has been launched to provide employment to the youth of Uttarakhand?

(a) Rojgar        (b) Asha           (c) Highway     (d)        Jyoti”

and has given the answer to the Question No.77 (a) Rojgar.

According to the petitioner, in view of the website of the State Government, this was the right answer and the petitioner has not been given marks for the said answer, bringing down the merit of the petitioner by 01 mark. The said question was later on deleted by the respondent-Commission.

On 31.07.2023, a Co-ordinate Bench of this Court has asked learned counsel for the respondent-Commission to get instructions in the matter.

Today, on instructions, it is submitted by learned counsel for the respondent-Commission that the question was deleted for the reason that according to the subject expert, since the answer of the Question No.77 was HOPE (Helping Out People Everywhere) and the said answer was not given in the option to the Question No.77, therefore, question was deleted.

He further submitted that since the question has already been deleted, therefore, none of the candidates got any marks to the Question No.77 and thereby, no prejudice was caused to the petitioner.

Having heard the learned counsel for the parties and going through the material available on record, this Court is of the opinion that firstly, on the one hand, if the question is deleted, no prejudice has been caused to the petitioner vis-a-vis the private respondent-Devendra Singh who has been finally selected for the post of Revenue Sub-Inspector (Patwari) pursuant to the aforesaid selection process and secondly, if the question is now to be included, in that event also, the marks will be obtained by all the candidates if the right answer is given by them. In both ways, no benefit will be accrued to the petitioner.

Thus, this Court finds no reasons to interfere in the selection process.

In this view of the matter, there is no merit in the writ petition and accordingly, the same is dismissed.
