The present petition has been filed on behalf of the Petitioner for quashing of order dated 19.4.2010 vide which the application filed u/s 311 Cr.P.C was dismissed by JMIC, Ludhiana and order dated 16.9.2010 passed by Additional Sessions Judge (FTC), Ludhiana vide which the revision filed by the Petitioner against aforesaid order was also dismissed.
Learned Counsel for the Petitioner inter-alia contends that the statements of ASI Jaswinder Singh and ASI Jaswant Singh are material for the just decision of the case. He further submits that no efforts whatsoever were made by the trial Court to summon them and both are official witnesses and there was no fault on the part of the Petitioner for not producing these witnesses.
Heard learned Counsel for the Petitioner and perused the record.
In view of the submissions made by learned Counsel for the Petitioner, the present petition is disposed of with a direction to the trial Court to examine aforesaid two witnesses on the date fixed subject to payment of Rs. 5,000/- as costs.
