According to the petitioners, proceedings against them were initiated under Sections 166 and 167 of the Uttar Pradesh Zamidari Abolition & Land
Reforms Act (from hereinafter referred to as “UPZA&LR Actâ€) in the year 1995 and their Bhumidari land was vested in the State Government
vide order dated 20.11.1995. Against the said order, petitioners moved a recall application on 11.01.1996, which was allowed by Collector, Dehradun
on 15.01.1996 on the ground that while passing the earlier order, petitioners were not heard. Thereafter, Assistant Collector, Dehradun passed another
order on 27.08.1996, whereby again the land was vested in the State Government. Against the said order, petitioners filed a revision and the revisional
court (Additional Chief Revenue Commissioner, Uttarakhand), vide judgment and order dated 31.07.2009, remanded the matter back to the trial court
with the direction to take decision afresh after hearing both the parties.
Grievance of the petitioner is that the case is pending before learned Assistant Collector, Dehradun ever since remand order dated 31.07.2009,
therefore, petitioners have approached this Court seeking direction to the court concerned to expedite hearing of the said case.
Having regard to the facts and circumstances of the case, writ petition is disposed of with a direction to the Assistant Collector, Dehradun to hear
and decide the case No. 04 of 2009-10 as early as possible, preferably within four months from the date of production of certified copy of this order.
