Judgment
Shri Anil Kumar Jaiswal is present in Court pursuant to our order dated 10.11.2009. He denies the contents of the telegram, but at the same time he had issued a written note to the police that now he has no complaint.
After a long interrogation, he revealed that the telegram has been sent to the High Court by some Advocate. Irrespective of the contents of the telegram, the author of the telegram, who is a retired Government Servant, appears to be telling a lie before this Court.
Director of C.B.I. is, therefore, directed to take Sri Anil Kumar Jaiswal for lie detector and Narco test and submit its report on the next date of hearing.
At this stage, the author of telegram informed the Court that on his instructions one Advocate Sri Yaduvendra Singh Yadav has sent the telegram.
Looking to the condition that he is a retired Government servant and that at the end wisdom has prevailed upon him and he is accepting the truth, we impose a cost of Rs. 10,000/- for sending fake telegram to the High Court to be deposited in the Court of Chief Judicial Magistrate, Lucknow towards costs.
However, earlier part of the order directing the Director C.B.I. to take the author of telegram for lie detector and Narco test, is withdrawn.
This habeas corpus petition is accordingly disposed of.
