At the very outset, learned counsel appearing for the respondents has submitted that annual information return for the financial year 2006-07 relating to petitioner is not available with the respondents. Submission is that the direction made by this Commission vide its Order dated 12.01.2023 in this regard cannot be complied with because of the non-availability of the same.
Learned counsel appearing for the petitioner has submitted, on instructions, that in such a situation the petitioner does not wish to press this petition any further and may be permitted to withdraw the same with liberty to invoke another legal remedy that may be available to the petitioner with regard to the subject matter of the petitioner.
In view of the submission made by learned counsel for the petitioner the petition stands dismissed as withdrawn. The petitioner shall have the liberty to invoke any other legal remedy as may be available to him under law.
It may be made clear that the cost of Rs. 10,000/- which the respondents were directed to deposit in legal aid fund of NCDRC vide Order dated 28.06.2023 shall stand as it stood and must be complied with forthwith without fail.
The Registry is requested to send a copy each of this Order to all parties in the petition and to their learned counsel. The stenographer is requested to upload this Order on the website of this Commission immediately.
