Amol Rattan Singh, J.
In terms of the order of this Court dated 30.1.2018, the report of the learned Sub Divisional Judicial Magistrate, Samalkha, has been received, stating therein that the statements of the petitioners as also of respondent no.2 were recorded before that Court in support of the compromise reached between the parties and as per the assessment of the learned Magistrate, the compromise is genuine and has been entered into voluntarily and of the free will of the parties.
The statements have also been annexed with the report of the learned Magistrate.
In the FIR, though the allegations against the petitioners are that they had committed a theft after breaking the lock of the shop of the complainant and they had also threatened him, however the matter having been fully compromised between the parties of their own will and the complainant also stated to have been paid damages for the occurrence as per his statement recorded before the learned Magistrate, and ASI Parmod Kumar who is present in Court today having informed this Court on query that there is no other criminal case registered against the petitioners, this petition is allowed and FIR No.772 dated 3.12.2016, registered at Police Station Samalkha, District Panipat, for the alleged commission of offences punishable under Sections 380/420/427/447/467/468/471/120-B/506 IPC, is hereby quashed along with all other subsequent proceedings arising therefrom.
