The present Criminal Writ Petition has been filed with a prayer to transfer the investigation to the Central Bureau of Investigation in FIR No. 0011 of 2020, registered at Police Station Rajpur, District Dehradun, for the offences punishable under Sections 403, 420, 465, 467, 468, 471, 474 and 120-B of the Indian Penal Code, 1860.

The Writ Petition was earlier disposed of vide order dated 05.09.2022 passed by a Co-ordinate Bench of this Court on the statement of learned State Counsel that the charge-sheet had been filed in the matter. Subsequently, a recall application was filed stating therein that an incorrect statement had been made before the Court by the learned State Counsel. Thereafter, notice was issued.

Now, learned State Counsel, on the basis of written instructions received, submits that the charge-sheet has been submitted before the concerned Court and cognizance has thereafter been taken.

Since cognizance has already been taken by the concerned Court, the relief sought in the present Criminal Writ Petition does not survive.

Learned counsel for the petitioner requests that liberty may be granted to the petitioner to approach the concerned Trial Court for availing such legal remedies as may be available to him in accordance with law.

Accordingly, the present Criminal Writ Petition is disposed of with liberty as aforesaid.
