Judgment
Through this writ petition a prayer has been made to restrain the respondents from arresting the petitioner in C.B.I. Case Crime No. R.C. (4) (5) 97 Sc. IV New Delhi. Earlier the Court had restrained the respondents from arresting the petitioner on humanistic ground, namely, that his daughter was going to be married.
Sri G.S. Chaturvedi, learned counsel appearing on behalf of the petitioner, very fairly slates that the marriage of the daughter of the petitioner is over and that the petitioner is prepared to cooperate with the investigation and the C.B.I, may act accordingly.
Mr. Giridhar Nath, learned counsel appearing on behalf of the C.B.I, has taken up a stand that the interrogation of the petitioner was deferred in term of the earlier orders of the Court, but since the marriage of the daughter of the petitioner is over, it be allowed to proceed in accordance with law against the petitioner. Having appreciated the fair stand taken by learned counsel recorded as above, we dismiss this application. The C.B.I, is now free to act accordingly.
The Office is directed to hand over copy of this order to Sri Giridhar Nath learned counsel for the C.B.I, by tomorrow for its communication to and follow up action by the C.B.I. Application dismissed.
