By way of instant contempt petition, prayer has been made on behalf of the petitioner for initiation of contempt proceedings against the respondents for having willfully and intuitionally disobeyed the order dated 19.9.2016, passed by erstwhile Himachal Pradesh Administrative Tribunal, whereby learned Tribunal below, while calling for the reply from the respondents, directed them to keep one post of Data Entry Operator vacant.
Precisely, the grouse of the petitioner is that despite there being aforesaid order passed by erstwhile Himachal Pradesh Administrative Tribunal, respondents have filled in one post of Data Entry Operator.
Reply having been filed by the respondents i.e. Director, Environment, Science and Technology, Himachal Pradesh clearly reveals that one post of Data Entry Operator is lying vacant in the Department of Environment, Science and Technology, Himachal Pradesh, as such, no case for initiation of contempt proceedings is made out against the respondents.
In view of above, present petition is dismissed. Notices issued to the respondents are discharged.
