.

This petition was filed in May 2012 seeking relief that respondents may be directed to fix the pay of petitioner at par with his junior i.e. Shri Kartar Singh Dhiman from due date with all consequential benefits. On 20.6.2012, petition was admitted and thereafter, on creation of HP State Administrative Tribunal, it was transferred to said Tribunal vide order dated 9.3.2015 and thereafter it was never listed and now has been received back on abolition of Erstwhile HP State Administrative Tribunal and has been listed for first time.

Learned Deputy Advocate General has placed on record instructions dated 15.11.2012 received by office of Advocate General with copy of order dated 7.11.2012 attached therewith. The same is taken on record.

From the order placed on record, it is evident that it has been concluded by the Secretary (PWD) to the Government of HP that case of petitioner for stepping up his pay at par with his juniors Shri Kartar Singh Dhiman and Shri Raj Kumar Sud is having enough merit and is, therefore, accepted and accordingly, he had ordered that petitioner be stepped up at par with Shri Kartar Singh Dhiman and Shri Raj Kumar Sud from the date on which anomaly occurred with rider that arrears on this account will be regulated by the instructions issued by Finance Department in this regard from time to time.

In view of copy of order placed on record, nothing survives to be adjudicated in present petition. However, petitioner, if still aggrieved, would definitely have a right to file successive petition for redressal thereof.

In view of above, present writ petition is disposed of as infructuous with liberty to petitioner to file an independent petition for redressal of his grievance(s), if any, survives.
