Judgment
Sabina, J
Petitioner has filed this petition under Article 226 of the Constitution of India, seeking following reliefs:-
“i. That the respondents may kindly be directed to refix the pay of the petitioners and to further protect the pay of the petitioners as under FR22(1)(a)(i) to next stage higher than lastly drawn to the post of lecturers on promotion as Headmaster.
ii. That the respondents may kindly be directed to provide all consequential benefits to the petitioners as per the fresh fixation of pay.
iii. That the respondents may kindly be directed to consider the case of th epetitioners in the light of the directions passed by the Hon'ble Court in judgment dated 07.07.2022 in CWP No. 842 of 2017 titled as “State of HP & Ors. Vs. Sardari Lal”.”
Learned counsel for the petitioner has submitted that the case of the petitioner is covered by the decision given by this Court (Annexure-VII) in State of Himachal Pradesh & Others Vs. Sardari Lal and Another, (2022) SCC Online HP 3612.
Accordingly, without adverting to the merits of the case, we deem it appropriate to dispose of the writ petition by directing respondents to consider the case of the petitioner in terms of decision of this Court (Annexure P-VII) in State of Himachal Pradesh and Others. Vs. Sardari Lal and Another, (2022) SCC Online HP 3612, expeditiously, in accordance with law, preferably within three weeks from the date of receipt of a copy of this order.
Pending miscellaneous application(s), if any, shall also stand disposed of.
To come up for compliance on 16 th June, 2023.
