This is the first application filed under section 483 of BNSS, 2023 for grant of bail on behalf of applicant Vijay Kahar S/o Lochan Kahar in connection with Crime No.870/2025, registered by Police Station - Kareli District Narsinghpur under section 34(2) of M.P. Excise Act.

The allegation against the present applicant is that he was transporting illicit liquor and on receipt of information police Kareli seized 126 bulk litres liquor from the possession of present applicant and thereafter registered the case against the present applicant on 19.10.2025 and since then he is in custody.

Counsel for the applicant submits that there is no past criminal record of the present applicant, he is innocent and has been falsely implicated in the present case. Investigation is almost over. Present applicant is in custody since 19.10.2025. He prays for grant of bail to the present applicant.

Per contra, learned Panel Lawyer opposed the bail application on the ground that 126 bulk litres illicit liquor has been seized from the possession of the present applicant. Sufficient material is available against the present applicant and investigation is still pending. He prays for dismissal of the present application.

Without commenting on the merits of the case, considering the fact that the applicant is in custody since 19.10.2025, investigation is almost over, offence is triable by JMFC and no case registered against the present applicant under Section 34(2) of MP Excise Act in past, I deem it proper to allow this application.

Accordingly, the application is allowed. The applicant is directed to be released on bail on his furnishing a personal bond of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like amount amount to the satisfaction of trial Court. It is directed that the applicant shall comply with conditions as enumerated under section 480(3) of BNSS.

A copy of this order be sent to the trial court.
