The applicants have filed this first bail application under section 439 of the Cr.P.C. for grant of bail.
The applicants are in custody since 14.10.2020 in connection with Crime No. 542/2020 registered at Police Station Gorakhpur, District Jabalpur (M.P.) for the offences punishable under Sections 363, 363-A of IPC.
The allegations against the present applicants are that they abducted the minor and forced her to beg.
Learned counsel for the applicants submits that the applicants have been falsely implicated in the matter. It is stated that the mother of the minor also appeared before the trial Court and stated that she has no objection if bail is granted to the present applicants. On this ground it is prayed that the present applicants be released on bail.
On the other hand, learned Panel Lawyer vehemently opposed the bail application. It is pointed out that the statement of the minor has been recorded and she has clearly mentioned that she was beaten up and forced by the present applicants to beg.
Considering the statement of the minor, I am of the view that the present is not a fit case to enlarge the applicants on bail, hence, this application filed under Section 439 of Cr.P.C. is hereby rejected.
