He also submitted that one previous case of similar nature is pending against the petitioner, hence, he opposed for grant of bail to the petitioner.
Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) and perused the materials available on record.
In order to curb the illegal activities of smuggling and selling of banned tobacco products, this Court is of the opinion that the petitioner shall deposit a sum of Rs.30,000/- (Rupees Thirty Thousand only) to the credit of Madras High Court Advocate Clerks Welfare Association, Chennai, without prejudice to his rights and contentions before the trial Court. Merely, because the petitioner deposits the said amount, it would not amount to admission of his guilt. Therefore, it is open to the trial Court to deal with the case independently.
Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel for the petitioner and considering the fact that the similarly placed co-accused have been released on bail, this Court is inclined to grant bail to the petitioner with certain conditions.
