Vidhya Bai vs State of M.P. and Others

Heard. This appeal has been filed by the appellant against the order dt. 26.4.2010 passed by the learned Single Judge in W.P. No. 1/2010 (S).

The appellant challenged the order dt. 18.3.2010 on the ground that earlier in the year 2006 an advertisement was issued inviting the applications for appointment to the post of Panchayat Karmi and the Panchayat appointed the Panchayat Karmi, hence, the subsequent advertisement is contrary to law.

Learned writ court dismissed the writ petition after observing the fact that the advertisement was issued in the year 2005 and it was under challenge before the writ court and the Gram Panchayat was directed to pass a fresh resolution vide order dt. 5.10.2007 and thereafter the Gram Panchayat did not pass any resolution. Hence, the new advertisement was issued in the year 2010. It is submitted that the person has already been appointed in pursuance to the aforesaid advertisement. In this view of the matter, in our opinion, there is no merit in this writ appeal. It is hereby dismissed. No order to costs.
