This revision petition (execution) has been filed under section 21(b) of the Act 1986, challenging an Order dated 22.10.2007 passed under section 27A.
Learned counsel for the petitioner submits that in the light of Hon'ble Supreme Court 's Order dated 06.05.2019 in Karnataka Housing Board vs. K.A. Nagamani (2019) 6 SCC 424, it is clear that revision under section 21(b) does not lie against an order passed under Section 27A of the Act 1986.
Remedy against an Order passed under section 27A of the Act 1986 (corresponding section 73 of the Act 2019) does not lie under section 21(b) of the Act 1986 (corresponding section 58(1)(b) of the Act 2019).
The instant revision petition (execution) is dismissed as not maintainable.
The Registry is requested to send a copy each of this Order to the respondents and to the District Commission within three days from today. The stenographer is requested to upload this Order on the website of this Commission today itself.
