This petition has been filed seeking to set aside the condition imposed by the Court below insisting for the production of solvency certificate in order to release the petitioner on bail.

The petitioner was arrested and later, was ordered to be released on bail by an order passed in Crl.R.C No.1461 of 2017. This Court imposed a condition whereby the petitioner was directed to execute a bond for a sum of Rs.10,000/- with two sureties for a likesum.

The grievance of the petitioner is that the petitioner executed a bond for a sum of Rs.10,000/- and his wife and sister stood as sureties and they also executed a bond for a likesum. However, the Court below was insisting for the production of a solvency certificate and the petitioner was not in a position to produce any solvency certificate and as a result of the same, the petitioner is not able to come out on bail. Hence, this petition has been filed before this Court.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondent police.

Taking into consideration the facts and circumstances of the case, the Court below is directed to permit the petitioner to execute a bond for a sum of Rs.10,000/- with two sureties for a likesum. The Court below shall not insist for a solvency certificate in this regard. The other conditions imposed by this Court in Crl.R.C No.1461 of 2017 shall stand as it is.

This Criminal Original Petition is disposed of accordingly.
