This petition is filed seeking bail in Crime No. 106/2011 of Kodigenahalli Police Station registered on 13.09.2011 for the offences under Sections 304 and 201 IPC.
The case of the petitioner is that in order to protect the crop from the wild animals, the petitioner had put electric wire fencing. The deceased came into contact with the said fencing and succumbed to the injuries sustained by electric shock. Further the case of the petitioner is that he has removed the dead body of the deceased and thrown it at some other place in order to conceal the offence.
Heard Sri Nagabhushana Reddy, learned Counsel for the petitioner and Sri Vijaya Kumar Majage, learned HCGP for the respondent State.
Learned HCGP opposes the bail application and he prays for dismissal of the petition.
I have gone through the materials on record. Having regard to the fact that the petitioner is aged about 65 years and the offence is not punishable with death or imprisonment for life, the petitioner can be released on bail. Hence, the petition is allowed on the following condition :-
a. The petitioner is directed to be released on bail on his executing a bond for Rs 25,000/- with one surety for the likesum to the satisfaction of the Court below.
