Judgment
CASE under Section 17 of the Consumers Protection Act, 1987 praying that in the circumstances stated in the memo, of grounds filed herein the State Commission will be pleased to pass a decree in petitioner''s favour granting all the compensation claimed by petitioner for the losses incurred by petitioner: (1) Hence I pray that a decree granting a compensation of Rs. 2,50,000/- which is the value of the building constructed by petitioner for protection together with the compound wall around the same which was demolished; (2) The Cost payable by petitioner to the 3rd respondent for the litigation conducted by him against petitioner as ordered by Court and as per the Costs memo, filed by the petitioner; (3) The Amount of expenses for defending in the suits etc., filed by the 3rd respondent against petitioner as shown in the above particulars of costs; (4) To pass an order that respondents 1 and 2 who collected the expenses for demolishing the houses constructions by the petitioner from the petitioner to pay to the petitioner by respondents 1 and 2.
THIS case coming on for hearing upon perusing the memo, of grounds filed herein and the Commission made the following order :- The contents of this complaint reveal that the dispute between the parties relates to immovable property. It does not pertain either to goods or services contemplated under the provisions of the Consumer Protection Act, 1986. Therefore, the complaint is not maintainable. It is accordingly dismissed. Complaint dismissed.
