The case of the proseuction is that, due to a family dispute, the petitioners, who are the brother and father of the first accused, abused the deceased Kattabomman in filthy language, assaulted him with a wooden log, pushed him to the ground, and kicked him on the chest, resulting in his death. Hence, the case.
The learned counsel for the petitioners submitted that the petitioners are innocent and have been falsely implicated in this case. He further submitted that the petitioners have been in judicial custody since 26.07.2026. He also further submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioners.
Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that the petitioners, due to a family dispute, abused the deceased in filthy language, assaulted him with a wooden log, and kicked him on his chest, resulting in his death. He further submitted that the investigation is completed and charge sheet filed. Hence, he strongly opposed the grant of bail to the petitioners.
I have given my anxious consideration to either side submissions and perused the materials available on record.
Considering the facts and circumstances of the case, the nature of the allegations, and the relationship between the petitioners and the first accused, this Court is inclined to grant bail to the petitioners, subject to certain conditions.
