Judgment
Sunder Mohan, J
This Criminal Original Petition is filed to quash the impugned final report in C.C.No.84 of 2023 on the file of the Additional Mahila Court (Magisterial Level), Nagercoil, which was filed for the offences under Section 3(1), 4, 6 of Dowry Prohibition Act, 1961, Section 406 and 498(A) of IPC.
The allegation in the final report is that the first accused, who is the husband of the defacto complainant, had demanded a sum of Rs.20,00,000/- as dowry and had caused cruelty in connection with dowry demand; and that the petitioner, who is the maternal aunt of the first accused, had also caused cruelty to the defacto complainant whenever she visited the matrimonial home.
The learned counsel for the petitioner would submit that the allegations against the petitioner are vague and attended with malafides; and that the petitioner has been falsely roped in this case only to wreak vengeance on the first accused.
There is force in the submission made by the learned counsel for the petitioner. Hence, the personal appearance of the petitioner before the Trial Court is dispensed with.
