This writ petition has been filed seeking a direction to the respondents to consider the petitioner's representation dated 14.02.2022 and pay compensation of Rs.5,00,000/- to the petitioner for the amputation of the toes of his left foot and the continuous medical treatment necessitated by the injuries sustained by him.

The Superintending Engineer, Tamilnadu Generation of Electricity and Distribution Corporation, Madurai is suo motu impleaded as 4th respondent in this writ petition. Registry is directed to carry out necessary amendment.

The learned Counsel appearing for the petitioner would submit that the petitioner had submitted a representation seeking compensation for the amputation of the toes of his left foot and for the other injuries sustained by him. However, the said representation has not been considered by the authorities so far. Hence, the present writ petition has been filed.

The learned Standing Counsel appearing for the respondents would submit that it is for the fourth respondent to consider the request of the petitioner.

It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon him to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. As such, non-consideration of the representation by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking its extraordinary powers under Article 226 of the Constitution of India and direct them to consider the same within a stipulated time.

In the light of the above observations and also the submissions made, there shall be a direction to the respondents to consider the petitioner's representation dated 14.02.2022 in the light of the board proceedings and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition Stands disposed of. No costs.
