Judgment
This is an application filed by IRP under Section 12-A for withdrawal of main application. Vide order dated 21.02.2022 Mr. Kamal Aggarwal was appointed as an Interim Resolution Professional (IRP) of the corporate debtor. Learned Counsel states that after publication of the notice, the claims were received but before CoC could be constituted, the matter is settled, hence, applying for withdrawal. The consent in the form 'FA' is also annexed with the application. IRP further states that the CIRP costs as on date is paid and nothing is due and payable. Considering the submissions made, we allow the application, thereby IB-1367/ND/2019 is allowed to be withdrawn. IRP is discharged from the duties to act as IRP of the Corporate Debtor assets of the Corporate Debtor should be handed over to the Corporate Debtor within five days from this order. IA-1438/ND/2022 is allowed and IB-1367/ND/2019 is disposed of as withdrawn.
