Judgment
S.R. Krishna Kumar, J
After arguing the matter for sometime, learned counsel for both the parties submit that the suit in O.S.No.74/2026 is posted before the trial court on 18.02.2026 and therefore, the trial court may be directed to consider and pass appropriate orders on I.A.No.1 filed under Order 39 Rules 1 and 2 CPC for temporary injunction within a period of one month from 18.02.2026. The said joint submission is placed on record.
Accordingly, the petition stands disposed of by directing the trial court to consider and pass appropriate orders on the aforesaid application I.A.No.1 within a period of one month from 18.02.2026 in accordance with law. All rival contentions between the parties are kept open and no opinion is expressed on the same. In the meanwhile, without prejudice to the rights and contentions of the parties, both the parties are directed not to alienate, encumber or create any third party rights over the suit schedule property till the disposal of I.A.No.1 by the trial court.
