The learned APP seeks time to file reply.
Shri Humane, learned Counsel for the applicant insisted for interim bail considering the nature of the crime and the allegations.
Learned Counsel submitted that the applicant is in custody since 02/07/2019. He is of age 22 years. The age of the girl is around 17 years.
It is a case of love affair and consensual sexual intercourse. The investigation is completed and the charge-sheet has already been filed before the Special Court, Akola.
Considering the aforesaid submissions and the uncertainty created due to the pandemic of Covid-19, I am inclined to protect the applicant by way of interim bail. Hence, this order :
(i) The applicant shall be released on interim bail in Crime No. 114/2019 registered with Police Station Pinjar, District Akola for the offence punishable under Sections 376(2)(f)(i)(n) and 506 of the Indian Penal Code read with Sections 4, 6 and 10 of the POCSO Act, 2012 on execution of P.R. Bond in the sum of Rs.15,000/- (Rs. Fifteen thousand only) with one surety in the like amount.
(ii) The applicant shall not give threats to the witnesses or tamper with the evidence.
