While issuing notice of motion, following order was passed:-

Learned counsel for the petitioner INTER-ALIA contends that the petitioner was declared as proclaimed offender vide impugned order dated 24.02.2020 (Annexure P-3) in FIR No.240 dated 26.12.2016 registered for offences punishable under Sections 420/120-B IPC and Section 13 of Punjab Prevention of Human Smuggling Act at Police Station Sadar Amritsar, District Amritsar during the time he was not residing at Sirhind but was residing in Chandigarh thus the proclamation issued was without execution of any summon/ warrants against the petitioner. Apart from that the parties i.e. petitioner as well as the complainant have already compromised and settled the matter.

Mr. Tarun Aggarwal, Sr. DAG, Punjab appears and accepts notice on behalf of respondent No.1-State and seeks time to file reply. Mr. Tajveer Singh, Advocate has entered appearance on behalf of respondent No.2.
Adjourned to 30.10.2023.
In the meantime, operation of the impugned order dated 24.02.2020 (Annexure P-3) shall remain in abeyance subject to the condition that the petitioner shall appear before the concerned Court on or before 25.09.2023.
Today, State counsel on instructions from ASI Gurcharan Singh submits that the petitioner pursuant to order dated 14.09.2023 has not surrendered before the trial Court.
Counsel for the petitoner pleads no instructions.
