Judgment
Alok Mahra, J
Applicant Vakila, who is in judicial custody in Case Crime/ FIR No.426 of 2024, under Section 80 (2) of B.N.S., 2023, registered at Police Station Jaspur, District Udham Singh Nagar, has sought her release on bail.
Heard learned counsel for the parties and perused the material available on record.
Learned counsel for the applicant would submit that the applicant is innocent and has been falsely implicated in the instant crime and is languishing in jail since 04.10.2024; that, applicant is a senior citizen and is suffering from various old age ailments; that, no specific role has been assigned to the applicant; that, at the time of Panchnama, the complainant was there, but at that time, the FIR was not lodged; that, the FIR is delayed one, inasmuch as, the alleged incident took place on 11.08.2024, however, the FIR was lodged after a lapse of 13 days i.e. on 24.08.2024 and furthermore, there is no demand of dowry, therefore, the applicant is entitled to be released on bail.
Learned D.A.G. appearing for the State vehemently opposed the bail application, however, he would fairly submit that the FIR is delayed one.
In view of the above, but, without expressing any opinion about merits of the case before the Trial Court, this Court is of the view that this is a fit case for bail.
The bail application is thus, allowed and the applicant is directed to be released on bail on her executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
