S.S. Subramani, J.—The Petitioner seeks to issue a writ of mandamus forbearing the first Respondent from transferring and handing over the Management of the Vellore Cooperative Sugar Mills Matriculation School - first Respondent, without following the regulations and pass such further order or orders as the Court may deem fit and proper.

The Petitioner is a teacher of the first Respondent school and regarding the salary payable to him and other teachers, writ petitions are pending. In the meanwhile, the first Respondent has notified that the School and the properties are to be transferred. The grievance of the Petitioner is if the transfer is allowed to take place, that will affect their right. It is also said that it is in violation of Rule 26 of the Code of Regulations of Matriculation Schools in Tamil Nadu.

I am sure that Respondents 2 and 3 will take necessary action under Rule 26 of the Code of Regulations for Matriculation Schools which prescribes certain conditions before the School is allowed to be transferred by the Management. The question whether the Petitioner''s rights are to be protected or not is also a matter which the authority has to consider if the transfer of the School is ordered. The first Respondent is also directed not to transfer the School except in accordance with law. The Writ Petition is disposed of accordingly. Consequently, W.M.P. No. 7731/98 is dismissed.
