V. Santhakumari Amma, Manager vs University of Kerala and The Vice Chancellor

T.R. Ramachandran Nair, J.—The petitioner is the Manager of a Teacher Education College conducting B.Ed.Course. The main prayer in the Writ Petition is for a direction to the respondents to appoint/include the Examiner for Social Science in the Practical Board visiting the petitioner''s College as per Exhibit P7 communication. The second prayer is to issue a direction to issue formal orders of affiliation for the additional optional subjects Social Science and Commerce. The 3rd prayer is to declare the withheld result of first Semester B.Ed. Examination of the Social Science batch students admitted in the petitioner''s College during the academic year 2008-09.

The University has filed a statement to the effect that the Standing Committee of the Syndicate for Affiliation of Colleges and Courses of Studies considered the petitioner''s matter with regard to the affiliation of new courses in its meeting held on 9.10.2009 and recommended that permission be granted to conduct practical examination to the candidate admitted for B.Ed.degree course in Social Science.

The petitioner has filed I.A. No. 11603/10 producing Exhibit P11 request made for issuing formal orders of affiliation for the additional subjects, Social Science and Commerce. It is averred in the affidavit that Exhibit P3 order was issued informing that it was decided to grant provisional affiliation to the new B.Ed.Course in Social Science and Commerce. The result of the first batch of the students has been published by the University and second batch also was admitted and their course also completed. The University directed the petitioner to remit the affiliation fees and the annual administration fees. That was challenged by the petitioner by filing W.P.(C) No. 11622/10 and this Court has granted stay with regard to the payment of annual administration fees. Therefore, the petitioner has sought for a direction to the respondents to issue formal orders of affiliation for the additional subjects Social Science and Commerce.

Heard the learned Standing Counsel for the University. It is submitted by him that W.P.(C) No. 11622/10 is still pending. In the light of the interim order of stay of payment of annual administration fees, the University cannot collect the same now. Therefore, there will be a direction to the University to issue W.P.(C) No. 27720/09 -3-formal orders of affiliation for the additional optional subjects Social Science and Commerce within a period of three weeks from the date of receipt of a copy of this judgment.

The Writ Petition is accordingly disposed of.
