P.D. Dinakaran, J.—The writ appeal Is filed against the Interim order dated 17.3.2005 refusing to grant injunction restraining the

respondents 2 to 4 from accepting the joining report of the 5th respondent as Assistant Professor In Crop Physiology in Rice Research Station,

Sevapet Thirur, Thiruvellore District.

Learned Single Judge, taking into account the fact that the 5th respondent has already joined on 21.2.2005, refused to grant injunction as

prayed for by order dated 17.3.2005. Aggrieved by the same, the writ petitioner has preferred the above appeal on the ground that before

permitting the 5th respondent to join duty, respondents 2 and 3 ought to have waited for the petitioner to join duty but the petitioner was intimated

about his selection only on 18.12.2005. However, it is not in dispute that the 5th respondent had joined duty on 21.2.2005.

2.1 If that be so, we do not see any Justification to grant injunction as prayed for. Hence, the writ appeal is dismissed. However, the Registry is

directed to expedite the writ petition. No costs. Consequently, WA. MP. No. 1866 of 2005 is also dismissed.
