The Writ Petition is to direct the respondent to permit the petitioner to conduct Krishna Jeyanthi Festival in front of Sri Aathi Mariappan Temple scheduled from 04.09.2026 and 05.09.2026 and allow the petitioner to conduct Thiru Vilakku Poojai, Games for children's, annathanam and cultural programme (Aadal Paadal) on the scheduled days and consider the petitioner's representation dated 26.08.2026.

The petitioner is filed seeking permission from the respondent to conduct the Krishna Jeyanthi Festival on 04.09.2026 and 05.09.2026, for which, the petitioner has already sent the representation dated 26.08.2026. Having not considered by the respondent police, the petitioner is before this Court for suitable direction to grant permission. The petitioner sent a representation dated 26.08.2026, which reveals that for two days i.e., 04.09.2026 and 05.09.2026 on account of Krishna Jeyanthi festival there will be a competitive sports among the children, Thiru Vilakku Poojai and followed that annathanam on 04.09.2026 and on the next day i.e., 05.09.2026 there will be a Uriyadi and other cultural programme. Therefore, he sought for permission of the police.

The learned Counsel for the petitioner further submitted that though the representation was given as early as on 26.08.2026, as instructed by his client, the learned Counsel submitted that yesterday [02.09.2026] the Deputy Superintendent of Police, Ramanathapuram called the petitioner for appearance today [03.09.2026]. However, the representation was sent only to the Inspector of Police, Thangachimadam Police Station. Therefore necessary direction may be given to conduct the festival.

The learned Government Counsel submitted that though the petitioner made a representation to the respondent police, the respondent forwarded the representation to the Deputy Superintendent of Police, Ramanathapuram for suitable orders. The Government Counsel pointed out that as per the pamphlet attached in the typed set of papers there is a competitive sports for elders. On the next day i.e., 05.09.2026 at 7.00 p.m., there will be a “Grand Aadal Paadal Programme” which cannot be permitted. Finally, the learned Government Advocate submitted that if the event is going to be organized among the children, ladies and usual competitive sports among the elders, there is no problem at all. However, for Aadal Paadal Programme the police has serious objection.

In turn, the learned Counsel for the petitioner submitted that they won't conduct any Aadal Paadal Programme and submitted that the organizer of the event, i.e., the petitioner, mentioned that the elders may throw the ball, musical chair and other cultural programme prevailing in the village alone will be conducted. Having the petitioner counsel submitted that the petitioner would not conduct Aadal Paadal Programme, which is not found in the representation, permission is granted to the petitioner only to conduct Krishna Jeyanthi festival, as per the pamphlet attached in the typed set of papers except “Grand Aadal Paadal Programme”. If the petitioner intends to start the Grand Aadal Paadal Programme the police are directed to stop the entire programme and take legal action against the petitioner at once.

Even though, the petitioner has not sought for any police protection, as per the submission of the learned Government Advocate, the petitioner should not conduct Aadal Paadal, for which the police may watch the programme of the petitioner dated 05.09.2026. If any Aadal Paadal Programme is to be commenced, the police has the power to stop the programme and take further action.

With the above direction, this writ petition is disposed of.
