Supplementary affidavit in terms of order dated 7.7.2020, is stated to have been filed, but the same is not on record. Registry to trace and place the same on record, if in order.
Learned counsel representing the petitioner while fairly admitting the factum with regard to receipt of pension, contends that though petitioner has been paid pension w.e.f.1.1.2018, but as per the order/judgment alleged to have been violated, he is entitled to pension w.e.f.31.3.2012 from the date of his superannuation. In the aforesaid background, learned counsel representing the petitioner states that at this stage, he may be permitted to withdraw the present petition with liberty to file appropriate proceedings in appropriate court of law qua the arrears of the pension.
Consequently, in view of the above, this Court sees no reason to keep the present petition alive and as such, same is accordingly closed. However, liberty is reserved to the petitioner to file appropriate proceedings in appropriate Court of law qua surviving grievances i.e. arrears of pension. Notice issued to the respondent is hereby discharged accordingly.
