Judgment
The present appeal by the Utkal University is directed against an order dated 25th February, 2020 passed by the learned Single Judge allowing W.P.(C) No.14858 of 2016 filed by the Respondent and directing that the University will pay to the Respondent the salary attached to the post of Manager, Utkal University Guest House in terms of th appointment order dated 22nd March, 2011 till the date of his retirement on 31st March, 2011 and that the pay of the Respondent and consequential post retiral benefits should be revised accordingly.
Having heard learned counsel for the parties, the Court is of the view that the impugned order which grants the benefit of the pay and allowances for the short period of 9 days when the Petitioner worked as Manger of the University Guest House does not require to be interfered with in the peculiar facts and circumstances of the case. The Court notes that the Respondent is now well over 70 years old. The monetary value of the post-retiral benefits is not so so substantial as to warrant interference at this stage. Nevertheless, the Court clarifies that the impugned order will not constitute a precedent and the questions of law raised by the Appellant are left open for decision in some other appropriate proceedings.
The writ appeal is accordingly disposed of.
