Heard Ms.Minati Behera, learned counsel for the petitioner.
This application has been filed by the petitioner-wife under Section 24 of C.P.C. for transfer of Civil Proceeding No.57 of 2022 filed by the opp. party-husband under Section- 13 (1) (i) (a) of Hindu Marriage Act in the Court of learned Judge, Family Court, Dhenkanal, to the Court of learned Judge, Family Court, Cuttack.
Learned counsel for the petitioner submits that the petitioner is working as Assistant Teacher in Ghantikhal Sabar Sahi Primary School at Ghantikhal since 06.06.2022 and she is staying in her father’s house in village, Nuasasan in the district of Cuttack on account of dowry demand by the opp. party-husband and his family members. She further submits that the distance between Family Court, Dhenkanal and her house, i.e., Nuasasan is about 42 K.Ms., for which it would be inconvenient for her to attend the Court on each date the case is posted to. She also submits that the petitioner is apprehensive for going to Dhenkanal because the friends of her husband who are antisocials used to threaten her over telephone and most of them are staying in Dhenkanal.
Considering the above submissions, issue notice to the opp. party in the main case as well as in the I.A. by registered/speed post with A.D., requisites for which shall be filed by 29.07.2022. The notice shall be made returnable within three weeks.
List this matter on 06.09.2022.
