The petitioner had availed credit facilities from the Okkal Service Co-operative Bank Limited. On default being committed, the Bank has initiated recovery proceedings to recover the amount due on the loan. According to the petitioner, she has now approached the Bank with Ext.P3 application seeking the benefit of the One Time Settlement scheme now in force (Ashwas – 2026). The petitioner is before this Court stating that the respondent may be directed to consider Ext.P3 application, in accordance with the provisions of the One Time Settlement Scheme now in force immediately; as the One Time Settlement scheme is expiring by the end of this month.

Having heard the learned counsel for the petitioner, I am of the opinion that this writ petition can be disposed of without issuing notice to the respondent as the only relief sought for by the petitioner is for a direction to the respondent to consider Ext.P3 request for One Time Settlement. Further, it would not be practical to issue notice to the respondent as the One Time Settlement scheme is to expire by the end of this month.

Accordingly, this writ petition will stand disposed of directing that the respondent shall consider Ext.P3 under the provisions of the One Time Settlement scheme now in force (Ashwas – 2026) and intimate to the petitioner the amount to be paid under the said scheme. Since the One Time Settlement scheme is to expire by 30.09.2026, it is directed that if the petitioner produces a copy of this judgment along with a copy of this writ petition before the respondent by 05.00 p.m tomorrow (29.09.2026), the respondent shall consider Ext.P3 and shall intimate to the petitioner the amount to be remitted in terms of the One Time Settlement scheme immediately. Registry is directed to issue a certified copy of this judgment today (28.09.2026) itself. Writ petition will stand disposed of as above.
