This application for bail has been filed by the applicant under section 439 of the Code of Criminal Procedure, 1973 in connection with FIR No.180/2023, registered at Police Station Basani, Jodhpur for the offences under sections 384 & 506 of the Indian Penal Code, 1860.
On perusal of the case diary, this Court finds that there is enough material to evince that the present applicant has been threatening the prosecutrix and her family members of dire consequences, if the FIR registered against him for the offence under section 376 of the Indian Penal Code, 1860, is not withdrawn.
Upon perusal of the records, it has also transpired that the applicant and his aids are continuously calling prosecutrix and her family members on their phones. This Court, therefore, does not find any reason to grant any indulgence to the present applicant.
The bail application is therefore rejected.
The complainant shall be free to move an application for vacation of the interim order which has been granted to applicant in S.B. Criminal Misc. Bail Application No.13898/2023.
