The matter is taken up through hybrid mode.
Heard Mr. D.P. Mohanty, learned counsel for the Appellants and Ms.P.Mohanty, learned counsel for the Respondents.
The appeal is admitted on the substantial question of law that;
whether execution of the sale deeds under Exts.5, 6 & 7 is void for want of permission under Section 22 of the OLR Act?
Issue notice to the Respondents.
Since Ms. Mohanty, learned counsel accepts notice on behalf of Respondents 1 to 3, one extra copy of the appeal memo be served on her.
Notice be issued to rest of the Respondents by registered post with A.D. for which requisites shall be filed within seven days.
List on 14th September, 2023. I.A.No.17 of 2023
As an interim, it is directed that there shall be stay of further proceeding in Execution Case No.24 of 2022 pending in the court of the learned Civil Judge (Jr.Division), Balasore till 14th September, 2023.
Urgent certified copy of this order be granted on proper application.
