Judgment
Hon''ble Rajiv Sharma, J.—Heard. Counsel for the applicants and Sri Lalit Shukla, Addl. Chief Standing Counsel appearing for the contemnors.
Instant contempt petition has been filed alleging non-compliance of the judgment and order dated 12.1.2007 passed in Writ Petition No. 1303 (SB) of 2005, SLP against which preferred by the State Government was also dismissed by the Apex Court vide its judgment and order dated 19.12.2008.
State Counsel states that in compliance of the aforesaid orders, the State Government considered the matter for grant of Career Advancement Scheme as recommended by the University Grant Commission and vide Government Order dated 13.5.2009 benefit of Career advancement Scheme has been granted and as such there is complete compliance of the order of this Court.
Counsel for the applicant states that it is incorrect to say that there is complete compliance of the order rather there is partial compliance and the judgment and order, referred to above, has not been complied with in its letter and spirit as "other benefits" which have been given by the writ court to the similarly situated counter parts have yet not been given, which shows that the contemnors have shown disrespect to the orders passed by the writ court. At this Stage, State Counsel states that regarding grant of "other benefits" to the petitioners, the State Government has decided to consider the demand enumerated in the representation dated 25.3.2011. In this regard, he has also invited the attention of the court towards the averments made in paragraph 10 of the affidavit of compliance filed by opposite party No. 4.
As an undertaking has already been given in the affidavits filed by the contemnors in this regard, no useful purpose would be served by keeping the instant contempt petition pending.
Accordingly, the notices issued to the contemnors are discharged and the contempt petition is dismissed. However, the contemnorsres pondents are directed to take the decision with regard to grant of "other benefits" as directed by the writ court to the applicants and granted to the counter-parts expeditiously i.e. within a maximum period of three months from the date of production of certified copy of this order.
