The petitioner challenges the action of the respondent in confirming only three out of the five shops for which he had successfully bid in the auction conducted.

The respondents have filed a statement wherein it is stated that the auction was originally confirmed in the name of the petitioner for all the five items but the amounts to be paid on confirmation were paid only with regard to three items and hence the other two items were re-auctioned. It is further submitted that since the re-auction did not fetch the amount which had been bid by the petitioner earlier, the Panchayat has not proceeded further with those re-auctions. The counsel for the Panchayat submits that if the petitioner is still willing to take those shops at the rate which he had offered initially, the same can be considered by the Panchayat. The petitioner says he is willing to pay the amount which he had bid earlier.

In such circumstances, the writ petition is disposed of directing the petitioner to approach the Panchayat within two days and submit his offer for the two stalls and if the offer is the same as what was offered initially, he shall be granted the stalls.
