UNIVERSITY OF CALCUTTA vs ARUN KUMAR SAHOO & ANR.

C.O. No. 71 of 2018 is moved in person by Professor

Shantanu Paul, Deputy Registrar, Shri Nishat Alam, Deputy Inspector of Colleges and Professor J.K. Das, Dean of Law Faculty, all of the University

of Calcutta, which is the petitioner herein.

Although a copy of the present revisional application had been served on the advocate for the caveators/opposite parties, no notice of the matter being

taken out of turn has apparently been given to the caveators/opposite parties.

Although there is extreme urgency in the matter, in view of the provision of Section 148A of the Code of Civil Procedure, the hands of this Court are

tied and no ex parte order can be passed without sufficient notice on the caveators/opposite parties.

As such, the petitioner is directed to serve a notice on the opposite parties directly and/or the learned advocate appearing for the opposite parties of

this Court and/or in the Court below, intimating the opposite parties that the matter will be taken up out of turn, in the absence of the opposite parties, if

necessary.

Liberty to the petitioner to mention the matter upon sufficient notice, as indicated above, being given.
