IA No.640/2023
The present IA No.640/2023 has been filed by operational creditor under Section 12A of the Code for withdrawal of the petition under Section 9 of the Code and for withdrawal of the CIRP of the Corporate Debtor along with the affidavit. The Form A has been submitted by Operational Creditor along with the Settlement Agreement dated 23.02.2023 annexed as Annexure A11. The Corporate Debtor was admitted to CIRP vide order dated 03.02.2023. No CoC has been constituted and no effective proceedings have been taken so far. The fee and other charges due towards IRP have been fully received. Keeping in view of the facts and circumstances mentioned in the application, IA No.640/2023 is allowed and disposed of and CP(IB) No.47/Chd/Chd/2021 is dismissed as withdrawn. As a consequence, the moratorium declared under Section 14 of the code comes to an end and the corporate debtor is discharged from the claims in lieu of the said petition and is free from the rigours of the Code and Regulations made thereunder. Henceforth, the IRP is discharged and the suspended board of Directors is restored to its original position. Thus, IA No.640/2023 and CP(IB) No.47/Chd/Chd/2021 are disposed of accordingly.
