MA 656/2020 In C.P.(IB)-1781/(MB)/2019

This is an application filed by the RP for withdrawal of the CIRP petition which was admitted on 7.11.2019. The Counsel for the RP is present. RP is also present. Counsel for the RP submits that the Financial Creditor has issued Form FA for withdrawal of the CP and the CoC also in the meeting held on 24.1.2020 resolved to withdraw this Company Petition with 100% majority.

Heard the Counsel for the applicant. RP submits that he has already received his fees. Since the application is in consonance with Section 12A of the Code and relevant regulations, this application is allowed and the petition disposed of as withdrawn.

The RP is directed to handover the Corporate Debtor to the erstwhile Directors of the Corporate Debtor. Corporate Debtor is relieved from the rigour of the Code and can function independently now.
