Union of India vs Usha Beltron Ltd.

Gupta, J.—On award dated October 25, 1996, being filed by Roshan Lal, Sole Arbitrator in Court, by the Order dated March 4, 1997, notices of the filing of the award were ordered to be issued to both the parties returnable on May 22, 1997. Union of India through the Executive Director, Railway Electrification/Stores, Railway Board, New Delhi, is reported to have been served with the notice on December 24, 1996 while M/s. Usha Beltron Limited, 503, Hemkunt Chambers, 89, Nehru Place, New Delhi, on April 8, 1997, but neither of them has filed any objections till date. Statutory period of limitation for filing objections having expired aforesaid award deserves to be made the rule of the Court u/s 17 of the Arbitration Act.

Consequently, the award dated October 25, 1996, is made the rule of the Court.

In terms of the aforesaid award a sum of Rs. 18,98,745/- is to be paid by M/s. Usha Beltron Limited to the Union of India. Order sheet dated May 22, 1997, reveals that Shri M. Singh, Advocate, on behalf of the Union of India, appeared before the Joint Registrar and informed him that the payment of the said amount has already been made by M/s. Usha Beltron Limited to the Union of India. That being so, claim of the Union of India under the award is dismissed as fully satisfied.
