Learned counsel for both sides are present. Learned counsel for respondent appeared after notice by this Tribunal and mentions that High Court of Delhi had seized of the matter in a Writ Petition involving the other question of time barred objection of this petition and date 12.1.2023 is fixed there at. Hence, this petition be listed on 16.1.2023. Counsel for petitioner, who is respondent in above Writ, is contesting there at.
Learned counsel for petitioner made an objection with this contention that in this very petition, stage is of final hearing. Both sides have led their evidences but at no point of time such objection with regard to limitation was raised except preliminary objection, already decided by this Tribunal.
More so, the Writ Petition pending before High Court of Delhi is being fixed and has no concern with present petition.
Let an application for above alleged facts of pending Writ and matter involved therein viz-a-viz having connection with present petition, be filed by counsel for respondent within two weeks. Objections, if any, may be filed within other two weeks.
