M.A. No. 752 of 2021

Vide this application, the applicants (respondents in OA), seek condonation of delay of 83 days in filing the review application being R.A. No. 09 of 2021. In view of the averments made therein, delay is condoned. Review application is taken on record.

MA stands disposed of accordingly.

This application has been filed for making certain corrections in the order passed by a Coordinate Bench of this Tribunal on 14.10.2020 in O.A. No. 491 of 2020. It is pointed out that in the order passed, the particulars of the total service rendered by the applicant in the Defence Security Corps (DSC) has been shown as 14 years 07 months and 21 days, whereas the correct position is that the applicant has rendered 14 years 7 months and 21 days service, which includes three days' nonqualifying service as he was absent during this period without leave. Accordingly, it is sought that the clarification may be made with regard to the period indicated also including the three days' non-qualifying service when he was absent without leave.

Taking note of the aforesaid, we direct that while calculating the total period of service rendered by the applicant in the DSC, the same be read as '14 years 07 months and 21 days, which includes three days' non-qualifying service on account of the applicant's absence without leave' and. therefore, as a consequence thereof, the shortfall of service would now be read as '04 months and 12 days'.

With the aforesaid clarification and modification of the order passed on 14.10.2020, this application is allowed.

This order shall be read conjointly with the order passed on 14.10.2020 in O.A. No. 491 of 2020.

R.A. No. 9 of 2021 stands disposed of.
