Judgment

This is an application filed by the applicants for modification of the order dated 23.05.2023 passed in WP(C) No.738 of 2022 and order dated 14.07.2023 passed in I.A. 01 of 2023 arising out of WP(C) No.738 of 2022.
Heard Mr. B. Majumder, learned Dy. SG appearing for the applicants-Union of India. Also heard Mr. Somik Deb, learned senior counsel appearing for respondent no.1 and Mrs. S. Deb(Gupta), learned counsel appearing for respondents nos.2 and 3.
This Court vide order dated 23.05.2023 passed in WP(C) No.738 of 2022 directed the applicants-Union of India to release the pension in favour of Smt. Bishnupriya Das, the wife and Miss Shreya Sutradhar, the daughter of the deceased government employee in equal shares within 4(four) weeks from the date of the order. Thereafter, vide order dated 14.07.2023 passed in I.A. 01 of 2023 arising out of WP(C) No.738 of 2022, this Court extended 8(eight) weeks time for implementation of the order dated 23.05.2023.
Mrs. Deb(Gupta), learned counsel appearing for Smt. Bishnupriya Das has submitted that the applicants-Union of India have not been releasing the pension in compliance of the orders dated 23.05.2023 and 14.07.2023.
Learned Dy. SG has submitted that the age of the daughter is two and half years and there are some complications to release the pension.
I have considered the submissions of learned counsel appearing for the parties.
To avoid any legal complications, I direct the competent authority-the Union of India to release the pension along with arrears in favour of Smt. Bishnupriya Das, the wife of the deceased government employee, namely Lt. Sanjoy Sutradhar within a period of 4(four) weeks from today.
With the aforesaid directions, the orders dated 23.05.2023 and 14.07.2023 stand modified. Accordingly, the instant I.A. stands allowed and disposed.
